Doing it Alone

Some people can (and should) file a Medicaid application on their own.  Others cannot or should not because of the complexity of their family finances, legal and/or other issues they may not appreciate.  I have prepared a checklist to determine whether professional assistance is needed in preparing and filing your Medicaid application.  Read each question below carefully and be as honest in your answers as possible.

  • Do I know the location of the Medicaid office where the application must be filed?
  • Am I familiar with all the documentation that must accompany the filing of a Medicaid application?  Do I know how to “package” the application correctly to obtain the most efficient processing by the assigned Medicaid caseworker?
  • Am I familiar with Medicaid laws regarding Medicaid eligibility, resource limits and spend down obligations, and do I have sufficient documentation to prove that all spend downs in my case are proper?
  • Am I familiar with NJ Medicaid laws regarding permissible vs. impermissible gifts, uncompensated transfers of assets, and other issues that may affect my eligibility?
  • Do I have enough documentation to explain transfers of funds and valuable property interests made within the past 5 years prior to filing to ensure they are legally protected?  If not, do I know what to do?
  • Do I have the 50+ hours that it is estimated a layperson will spend preparing, filing, and following to conclusion of a Medicaid application?
  • If the Medicaid eligibility caseworker asks questions, do I understand the process sufficiently to give him/her the correct and appropriate answers, which will not hurt me or the Medicaid application?
  • Do I know what a pre-admission screening (PAS) is and how important it is to filing a Medicaid application?
  • If the application is rejected, am I familiar with the time limits and rules for filing an appeal and requesting a Fair Hearing?
  • If my application has not been rejected but is also not approved in a timely manner and I’m being “jerked around”, am I familiar with my rights and the procedures for obtaining prompt action?
  • Do I know how to deal with the nursing home or assisted living residence when they are not being paid during the pendency of the Medicaid application? Do I know how much I must pay them every month until Medicaid is approved?
